Title:
'Esenzione', 'giusta autonomia' e 'speciale cura', tre istituti giuridici a tutela dei carismi della Vita consacrata e per la missione della Chiesa (cann. 591, 586, 594 CJC)
Description:
This article, having in mind the ecclesial value of charisms, from a legal and historical perspective, focuses its attention on safeguarding the spiritual patrimony of each Institute of Consecrated Life and the specific apostolic service they can render in the Church. The identity of a Religious Institute and the integrity of its charismatic patrimony demands due attention from the whole Church as an essential element that belongs to the life and holiness of the Church. As a consequence, the history of the Religious Orders have seen the evolution of legal machineries to regulate the ad intra and ad extra relations through juridical institutions which formally finds its place in the current Canon Law under the name “exemption”, “just autonomy” and “special care”, considering the continuity and innovation compared to the past.
